The State Property Committee of the Minsk Regional Executive Committee (hereinafter referred to as the Committee) is included in the system of the State Property Committee of the Republic of Belarus (hereinafter referred to as Goskomimushestvo), is its territorial body, performs special functions in the management, disposal, transformation, assessment and accounting of property owned by the Republic of Belarus, and at the same time is a structural subdivision of Minsk Oblast Executive Committee (hereinafter - the oblast committee) in the management, disposal, transformation, assessment and accounting of state property owned by Minsk Oblast.
The main task of the committee is to implement state policy on property relations, including management, disposal, privatization (with the exception of privatization of living rooms of the public housing), transformation, assessment and accounting of state-owned property, with the exception of relations in the use and protection of lands (including the determination of the amount of damages caused to land users by the seizure of land plots and demolition of real estate located on them, procedures and conditions for reimbursement for them), mineral resources, other natural resources, houses and flats, state property in insolvency and bankruptcy proceedings, as well as other property determined by the legislation of the Republic of Belarus.
In accordance with the main tasks, the committee performs the following main functions:
- prepares proposals for the implementation of state policy on property relations in terms of management, disposal, privatization, transformation, assessment and accounting of state-owned property, with the exception of relations in the use and protection of lands, mineral resources, other natural resources, houses and flats, privatization of living rooms of the public housing, as well as other property determined by the legislation of the Republic of Belarus;
- monitors compliance with the legislation of the Republic of Belarus on the use and disposal of state property assigned to legal entities with the right of economic or operational management, as well as transferred in accordance with the legislative acts of the Republic of Belarus for free use by non-state legal entities and public associations;
- coordinates and analyzes the work on engaging the unused and inefficiently used real estate owned by Minsk Oblast and its administrative and territorial units into economic circulation, prepares proposals on the methodological support of the bodies authorized by the oblast committee to manage organizations and property owned by Minsk Oblast (hereinafter the management bodies of the oblast committee), local executive and administrative bodies for engaging the unused and inefficiently used state real estate;
- provides methodological guidance and advice to the management bodies of the oblast committee on the connection joining communal unitary enterprises whose property is owned by Minsk Oblast to an open joint-stock company, prepares a conclusion on the correctness of determining the assessment of the property of the affiliated enterprise;
- carries out organizational and methodological support for the creation of the state information resource “Unified Register of Property”, as well as for updating the information included in it:
- city (cities of regional subordination), district executive committees;
- legal entities registered in the territory of the Minsk region, in relation to state property owned by the Republic of Belarus or the Minsk region;
- business companies, shares (shares in authorized funds) of which belong to the Minsk region, as well as the Republic of Belarus, registered in the territory of the Minsk region;
- business companies included in the holding, registered in the territory of the Minsk region, the management company of which is a business company, the shares (share in the authorized capital) of which belong to the state;
- borrowers registered in the territory of the Minsk region, in relation to property transferred to them under an agreement for gratuitous use with business companies created in accordance with the legislation on privatization (their legal successors), as well as with republican state-public associations, owned by the Republic Belarus or Minsk region;
- conducts a mandatory examination of the reliability of the assessment in relation to the estimated value of property located on the territory of the Minsk region (with the exception of residential buildings and residential premises, including unfinished construction, as well as historical and cultural values or cultural values that make up the Library Fund of the Republic of Belarus, the National Archive fund of the Republic of Belarus or included in the Museum Fund of the Republic of Belarus, as well as presented in the prescribed manner to give the status of historical and cultural value), owned by the Republic of Belarus and the property of the regions and the city of Minsk;
- considers the submitted documents on the transformation of republican unitary enterprises employing less than 1,000 people and municipal unitary enterprises whose property is owned by Minsk Oblast for compliance with the legislation of the Republic of Belarus and prepares a conclusion on the correctness of determining the size of the authorized capital of the open joint stock company;
- conducts a compulsory expert review of the reliability of the assessment with respect to property owned by the Republic of Belarus and Minsk Oblast, with the exception of living houses and living rooms, as well as objects of historical and cultural heritage;
- on behalf of the oblast committee organizes and conducts auctions (tenders) for the sale of:
- enterprises as property complexes of municipal unitary enterprises those property is owned by Minsk Oblast;
- shares (parts in authorized funds) of business entities owned by Minsk Oblast;
- organizes the exchange of shares of open joint-stock companies owned by the Republic of Belarus and Minsk Oblast, created in the process of transforming state unitary and leased enterprises, into “Property” privatization checks;
- provides, through the bodies exercising property control, the methodological guidance of the activities of state representatives in the management bodies of business entities whose shares (parts in authorized funds) are owned Minsk Oblast region and its administrative and territorial units;
- organizes and conducts auctions (tenders) for the sale of state-owned capital buildings (houses, structures), unfinished mothballed and non mothballed capital buildings, other facilities in cases established by the legislation and the oblast committee;
